Allah has forgiven my Ummah for the thoughts that come to their minds, unless they act upon them or utter them
Abu Hurayrah (may Allah be pleased with him) reported: The Prophet (may Allah's peace and blessings be upon him) said: "Allah has forgiven my Ummah for the thoughts that come to their minds, unless they act upon them or utter them."
A man divorced his wife three times, then another man married her and divorced her before consummating the marriage with her. Her first husband wanted to remarry her, and the Prophet (may Allah's peace and blessings be upon him) was asked about that. He said: No, not until the second husband tastes of her sweetness what the first one tasted
‘Ā’ishah (may Allah be pleased with her) reported: A man divorced his wife three times, then another man married her and divorced her before consummating the marriage with her. Three things are binding regardless of whether they were expressed seriously or jokingly: marriage, divorce, and restoration (of a divorcee)
Abu Hurayrah (may Allah be pleased with him) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) said: "Three things are binding regardless of whether they were expressed seriously or jokingly: marriage, divorce, and restoration (of a divorcee)."
The son of Adam cannot make a vow concerning what is not his; he cannot free a slave who is not his; and he cannot divorce a woman who is not his (wife)
‘Amr ibn Shu‘ayb reported from his father that his grandfather said that the Messenger of Allah (may Allah’s peace and blessings be upon him) said: “The son of Adam cannot make a vow concerning what is not his; he cannot free a slave who is not his; and he cannot divorce a woman who is not his (wife).”
أجعلك من شأني في حل
عن عائشة رضي الله عنها في هذه الآية: {وإن امرأة خافت من بعلها نشوزًا أو إعراضًا} [النساء: 128] قالت: "الرجل تكون عنده المرأة، ليس بمستكثر منها، يريد أن يفارقها، فتقول: أجعلك من شأني في حل، فنزلت هذه الآية في ذلك".
خيَّرَنا رسول الله صلى الله عليه وسلم فاخترنا الله ورسوله، فلم يعدَّ ذلك علينا شيئًا
عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ: خَيَّرَنَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَاخْتَرْنَا اللَّهَ وَرَسُولَهُ، فَلَمْ يَعُدَّ ذَلِكَ عَلَيْنَا شَيْئًا. وَفِي رِوَايَةٍ: عَنْ مَسْرُوقٍ قَالَ: سَأَلْتُ عَائِشَةَ عَنِ الخِيَرَةِ، فَقَالَتْ: خَيَّرَنَا النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، أَفَكَانَ طَلاَقًا؟ قَالَ مَسْرُوقٌ: لاَ أُبَالِي أَخَيَّرْتُهَا وَاحِدَةً أَوْ مِائَةً، بَعْدَ أَنْ تَخْتَارَنِي.
كانت أسماء بنت يزيد بن السكن أول من أنزلت فيها العدة للمطلقات
عَنْ أَسْمَاءَ بِنْتِ يَزِيدَ بْنِ السَّكَنِ الْأَنْصَارِيَّةِ أَنَّهَا طُلِّقَتْ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَلَمْ يَكُنْ لِلْمُطَلَّقَةِ عِدَّةٌ، فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ حِينَ طُلِّقَتْ أَسْمَاءُ بِالْعِدَّةِ لِلطَّلَاقِ، فَكَانَتْ أَوَّلَ مَنْ أُنْزِلَتْ فِيهَا الْعِدَّةُ لِلْمُطَلَّقَاتِ.
أيُّما امرأةٍ سألتْ زوجَها طلاقًا في غير ما بأسٍ فحرامٌ عليها رائحة الجنة
عَنْ ثَوْبَانَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «أَيُّمَا امْرَأَةٍ سَأَلَتْ زَوْجَهَا طَلَاقًا فِي غَيْرِ مَا بَأْسٍ فَحَرَامٌ عَلَيْهَا رَائِحَةُ الْجَنَّةِ».
أطع أباك
عَنْ عَبْدِ اللهِ بْنِ عُمَرَ قَاَل: كَانتْ تَحْتِي امْرَأةٌ، وَكُنْتُ أُحِبُّهَا، وَكَانَ عُمَرُ يَكْرَهُهَا، فََالَ لِيْ: طَلِّقْهَا، فَأَبيتُ، فَأَتَى عُمرُ النَّبِيَّ صَلَّى اللهُ عَلَيهِ وَسَلَّمَ، فَذَكَرَ ذَلِكَ لَهُ، فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيهِ وَسَلَّمَ: «طَلِّقْهَا»، وَلَفْظُ النَّسَائِيِّ: «أَطِعْ أَبَاكَ».
‘Abdullāh ibn ‘Umar (may Allah be pleased with him) divorced his wife while she was menstruating. So, ‘Umar (may Allah be pleased with him) informed the Messenger of Allah (may Allah’s peace and blessings be upon him) about that, and he became furious at him
‘Abdullāh ibn ‘Umar (may Allah be pleased with him) reported that he divorced his wife while she was menstruating. So, ‘Umar (may Allah be pleased with him) informed the Messenger of Allah (may Allah’s peace and blessings be upon him) about that, and he became furious at him and said: “Let him take her back and keep her until she becomes purified of menstruation, and then menstruates and then becomes purified of menstruation. Thereafter, if he decides to divorce her, he should divorce her while in a state of purity and before having intercourse with her. That is the ‘Iddah (post-divorce waiting period), as commanded by Allah, the Almighty. In another narration: “Until she enters the next menstrual period, other than the one during which he divorced her.” In yet another narration: “It was counted as one valid divorce, and ‘Abdullāh took her back at the command of the Messenger of Allah (may Allah’s peace and blessings be upon him).”
No financial maintenance is due to you upon him
Fātimah bint Qays (may Allah be pleased with her) reported that Abu ‘Amr ibn Hafs divorced her irrevocably, while he was not present (and in another narration: “divorced her thrice”). He sent some barley to her with his representative and she was displeased with it. So he said: “By Allah, you are not entitled to receive anything from me.” She came to the Messenger of Allah (may Allah's peace and blessings be upon him) and mentioned that to him. He said: “No financial maintenance is due to you upon him. (In another narration: 'or accommodation’)” Then the Prophet (may Allah's peace and blessings be upon him) ordered her to observe her ‘Iddah (post-divorce waiting period) in the house of Umm Sharīk; then he said: “This is a woman whom my Companions frequently visit, so observe your ‘Iddah at the house of Ibn Umm Maktūm. He is a blind man and you can disrobe in his house. Then when you complete your ‘Iddah, inform me.” She said: “When I completed my ‘Iddah, I mentioned to him that both Mu‘āwiyah ibn Abu Sufyān and Abu Jahm proposed to me. Thereupon, the Messenger of Allah (may Allah's peace and blessings be upon him) said: ‘As for Abu Jahm, he never takes his stick off his shoulder, and as for Mu‘āwiyah, he is destitute and penniless. Marry Usāmah ibn Zayd,’” whom she disliked. Then he said: “Marry Usāmah ibn Zayd.” Fātimah said: “So I married him and Allah placed a lot of good in him, and I was pleased with him.”
Do you want to go back to Rifā‘ah? Not until you taste his sweetness and he tastes your sweetness (have sexual intercourse)
‘Ā'ishah (may Allah be pleased with her) reported: The wife of Rifā‘ah al-Qurazhi came to the Prophet (may Allah's peace and blessings be upon him) and said: "I was with Rifā‘ah al-Qurazhi, and he divorced me and it was an irrevocable divorce. Then I married ‘Abdur-Rahmān ibn Az-Zubayr, and he only has the like of a garment's fringe." The Messenger of Allah (may Allah's peace and blessings be upon him) smiled and said: "Do you want to go back to Rifā‘ah? Not until you taste his sweetness and he tastes your sweetness (have sexual intercourse)." She (‘Ā'ishah) said: "Abu Bakr was with him, and Khālid ibn Sa‘īd was at the door waiting to be allowed in. Khālid called out: 'O Abu Bakr, do you not hear what this [woman] is saying? What is she saying openly in the presence of the Messenger of Allah (may Allah’s peace and blessings be upon him)!'"
Her prescribed waiting period after divorce is over. Propose to her anew
Az-Zubayr ibn al-‘Awwām (may Allah be pleased with him) reported that he was married to Umm Kulthūm bint ‘Uqbah when she said to him, while being pregnant: "Make me happy by proclaiming divorce one time.” So he divorced her once, then went out to the prayer. He returned after she had given birth to a child, then he said: “What is the matter with her? She deceived me! May Allah deceive her!” Then he came to the Prophet (may Allah's peace and blessings be upon him) who then said: “Her prescribed waiting period after divorce is over. Propose to her anew.”
Divorce whomever of them you wish
Ad-Dahhāk ibn Fayrūz reported from his father that he said: "I said: 'O Messenger of Allah, I have embraced Islam, and I have two sisters as wives!' He said: 'Divorce whomever of them you wish.'"
مره فليراجعها، ثم ليمسكها حتى تطهر، ثم تحيض ثم تطهر، ثم إن شاء أمسك بعد، وإن شاء طلق قبل أن يمس، فتلك العدة التي أمر الله أن تطلق لها النساء
عن عبد الله بن عمر رضي الله عنهما : أنه طَلَّق امرأته وهي حائض، على عَهْد رسول الله صلى الله عليه وسلم ، فسأل عمر بن الخطاب رسول الله صلى الله عليه وسلم عن ذلك، فقال رسول الله صلى الله عليه وسلم: «مُرْهُ فليُرَاجِعْهَا، ثم ليُمْسِكْهَا حتى تَطْهُر، ثم تحيض ثم تَطْهُر، ثم إن شاء أَمسَكَ بَعْدُ، وإن شاء طلق قَبْل أن يَمَسَّ، فتلك العِدَّةُ التي أمر الله أن تُطَلَّقَ لها النساء».
The (pronouncement) of three divorces during the lifetime of the Messenger of Allah (may Allah's peace and blessings be upon him) and that of Abu Bakr and two years of the caliphate of ‘Umar (was treated) as one
Ibn ‘Abbās (may Allah be pleased with him) reported: The (pronouncement) of three divorces during the lifetime of the Messenger of Allah (may Allah's peace and blessings be upon him) and that of Abu Bakr and two years of the caliphate of ‘Umar (was treated) as one. Then ‘Umar ibn al-Khattāb said: "Indeed, people hasten to a matter in which they used to act with deliberation. So if we would count them as three divorces," and he did that.
‘Abd Yazīd — the father of Rukānah and his siblings — divorced Umm Rukānah and married a woman from Muzaynah. So the new wife came to the Prophet (may Allah's peace and blessings be upon him) and said: He does not satisfy me except like this hair does
Ibn ‘Abbās (may Allah be pleased with him) reported: ‘Abd Yazīd — the father of Rukānah and his siblings — divorced Umm Rukānah and married a woman from Muzaynah. So the new wife came to the Prophet (may Allah's peace and blessings be upon him) and said: "He does not satisfy me except like this hair does — referring to a hair that she took from her head — so separate between me and him." So the Prophet (may Allah's peace and blessings be upon him) got angry and called Rukānah and his siblings. Then he said to those who were sitting with them: "Do you see that so-and-so resembles him in such-and-such?" meaning ‘Abd Yazīd, "and so-and-so resembles him in such-and-such?" They said: 'Yes.' Therefore, the Prophet (may Allah's peace and blessings be upon him) said to ‘Abd Yazīd: "Divorce her." So he did. Then he said: "Restore your wife, the mother of Rukānah and his siblings." He said: "I have divorced her thrice, O Messenger of Allah." He said: "I know; restore her." And he recited: {O Prophet, when you [Muslims] divorce women, divorce them for [the commencement of] their waiting period and keep count of the waiting period.} [Sūrat At-Talāq: 1]
You divorced (in a manner that is) against the Sunnah and took back (in a manner that is) against the Sunnah. Call someone to bear witness to her divorce and to her reunion, and do not do that again
‘Imrān ibn Husayn (may Allah be pleased with him) reported that he was asked about a person who divorced his wife and then had intercourse with her without calling any witnesses to the divorce or the reunion. He said: "You divorced (in a manner that is) against the Sunnah and took back (in a manner that is) against the Sunnah. Call someone to bear witness to her divorce and to her reunion, and do not do that again."
A slave has two counts of divorce to discharge toward his free wife, who shall observe a waiting period of three menstrual cycles. A free man has two counts of divorce to discharge toward his slave wife, who shall observe a waiting period of two menstrual cycles
