Were people to be given everything they claimed, some men would claim the properties and blood of (other) people. However, the onus of proof is on the plaintiff and the oath is upon the one who denies the claim (defendant)
Ibn ‘Abbās (may Allah be pleased with him) reported: The Messenger of Allah (may Allah's peace and blessings be upon him) said: "Were people to be given everything they claimed, some men would claim the properties and blood of other people. However, the onus of proof is on the plaintiff, and the oath is upon the one who denies the claim (defendant)."
The Messenger of Allah (may Allah's peace and blessings be upon him) cursed the one who gives a bribe and the one who receives a bribe to influence a judgment

إني والله ما آمن يهود على كتابي
عَنْ زَيْدُ بْنُ ثَابِتٍ قَالَ: أَمَرَنِي رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَتَعَلَّمْتُ لَهُ كِتَابَ يَهُودَ، وَقَالَ: «إِنِّي وَاللَّهِ مَا آمَنُ يَهُودَ عَلَى كِتَابِي» فَتَعَلَّمْتُهُ، فَلَمْ يَمُرَّ بِي إِلَّا نِصْفُ شَهْرٍ حَتَّى حَذِقْتُهُ، فَكُنْتُ أَكْتُبُ لَهُ إِذَا كَتَبَ، وَأَقْرَأُ لَهُ إِذَا كُتِبَ إِلَيْهِ.
إنكم تختصمون إلي، ولعل بعضكم أن يكون ألحن بحجته من بعض
عَنْ أُمِّ سَلَمَةَ قَالَتْ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «إِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ، وَلَعَلَّ بَعْضَكُمْ أَنْ يَكُونَ أَلْحَنَ بِحُجَّتِهِ مِنْ بَعْضٍ، فَأَقْضِيَ لَهُ عَلَى نَحْوٍ مِمَّا أَسْمَعُ مِنْهُ، فَمَنْ قَطَعْتُ لَهُ مِنْ حَقِّ أَخِيهِ شَيْئًا فَلَا يَأْخُذْهُ، فَإِنَّمَا أَقْطَعُ لَهُ بِهِ قِطْعَةً مِنَ النَّارِ».
The Messenger of Allah (may Allah's peace and blessings be upon him) heard voices arguing at the door of his house.
Umm Salamah (may Allah be pleased with her) reported: The Messenger of Allah (may Allah's peace and blessings be upon him) heard voices arguing at the door of his house. He went out to them and said: "I am only a human being, and you refer your disputes to me. Perhaps some of you are more eloquent than others, so I deem him truthful and rule in his favor. He whom I, by my judgment, give an undue share of a Muslim's right, then it is indeed a portion of fire, so let him burden himself with it or abandon it."
Whoever takes a false oath to deprive a Muslim person of his property unlawfully, will meet Allah while He is angry with him
‘Abdullah ibn Mas‘ūd (may Allah be pleased with him) reported: The Messenger of Allah (may Allah's peace and blessings be upon him) said: "Whoever takes a false oath to deprive a Muslim person of his property unlawfully, will meet Allah while He is angry with him." He said: Al-Ash‘ath said: By Allah, this was about me. I shared some land with a Jewish man. When he denied me my right, I complained against him to the Prophet (may Allah's peace and blessings be upon him). The Messenger of Allah (may Allah's peace and blessings be upon him) said to me: "Do you have any proof?" I said: No. So he said to the Jew: "Swear an oath." I said: O Messenger of Allah, he will swear an oath and seize my property. So, Allah Almighty revealed: {Those who trade the covenant of Allah and their oaths for a small price...} to the end of the verse.
If a judge issues a ruling, having tried his best to decide correctly, and his ruling is right, he will have a double reward, but if he issues a ruling, having tried his best to decide correctly, and his ruling is wrong, he will have a single reward
‘Amr ibn al-‘Ās (may Allah be pleased with him) reported: The Messenger of Allah (may Allah’s peace and blessings be upon him) said: "If a judge issues a ruling, having tried his best to decide correctly, and his ruling is right, he will have a double reward, but if he issues a ruling, having tried his best to decide correctly, and his ruling is wrong, he will have a single reward."
Shall I not inform you who the best witness is? He is the one who gives his testimony before he is asked for it
Zayd ibn Khālid al-Juhani reported that the Prophet (may Allah's peace and blessings be upon him) said: "Shall I not inform you who the best witness is? He is the one who gives his testimony before he is asked for it."
Anyone who takes a false oath at this pulpit of mine, even concerning a green tooth-stick, will surely occupy his seat in Hell
Jābir ibn ‘Abdullāh (may Allah be pleased with him) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) said: ''Anyone who takes a false oath at this pulpit of mine, even concerning a green tooth-stick, will surely occupy his seat in Hell – or he will surely enter Hell.''
يَسِّرا ولا تُعسِّرا، وبَشِّرا ولا تُنفِّرا
عن أبي بُرْدةَ قال: بعث رسول الله صلى الله عليه وسلم أبا موسى ومعاذ بن جبل إلى اليمن، قال: وبعث كل واحد منهما على مِخْلافٍ، قال: واليمنُ مخلافان، ثم قال: «يَسِّرا ولا تُعسِّرا، وبَشِّرا ولا تُنفِّرا»، -وفي رواية مسندة عن أبي موسى: «وتطاوعا ولا تختلفا»- فانطلق كل واحد منهما إلى عمله، وكان كلُّ واحدٍ منهما إذا سار في أرضه كان قريبًا من صاحبه أحدث به عهدًا، فسلم عليه، فسار معاذ في أرضه قريبًا من صاحبه أبي موسى، فجاء يسير على بغلته حتى انتهى إليه، وإذا هو جالسٌ وقد اجتمع إليه الناس، وإذا رجلٌ عنده قد جمعت يداه إلى عنقه، فقال له معاذ: يا عبد الله بن قيس، أَيْمَ هذا؟ قال: هذا رجلٌ كَفَرَ بعد إسلامه، قال: لا أنزل حتى يقتل، قال: إنما جيء به لذلك فانزل، قال: ما أنزل حتى يقتل، فأمر به فقتل، ثم نزل فقال: يا عبد الله، كيف تقرأ القرآن؟ قال: أَتَفَوَّقُه تفوُّقًا، قال: فكيف تقرأ أنت يا معاذ؟ قال: أنام أول الليل، فأقوم وقد قضيت جزئي من النوم، فأقرأ ما كتب الله لي، فأحتسب نومتي كما أحتسب قومتي.
اليمين على نية المستحلف
عَنْ أَبِي هُرَيْرَةَ قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «الْيَمِينُ عَلَى نِيَّةِ الْمُسْتَحْلِفِ»، وَفِي رِوَايَةٍ: «يَمِينُكَ عَلَى مَا يُصَدِّقُكَ عَلَيْهِ صَاحِبُكَ».
إنه لا قُدِّست أمَّة لا يأخذ الضعيف فيها حقه غير متعتع
عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ قَالَ: جَاءَ أَعْرَابِيٌّ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَتَقَاضَاهُ دَيْنًا كَانَ عَلَيْهِ، فَاشْتَدَّ عَلَيْهِ، حَتَّى قَالَ لَهُ: أُحَرِّجُ عَلَيْكَ إِلَّا قَضَيْتَنِي. فَانْتَهَرَهُ أَصْحَابُهُ وَقَالُوا: وَيْحَكَ، تَدْرِي مَنْ تُكَلِّمُ؟ قَالَ: إِنِّي أَطْلُبُ حَقِّي. فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «هَلَّا مَعَ صَاحِبِ الْحَقِّ كُنْتُمْ؟» ثُمَّ أَرْسَلَ إِلَى خَوْلَةَ بِنْتِ قَيْسٍ فَقَالَ لَهَا: «إِنْ كَانَ عِنْدَكِ تَمْرٌ فَأَقْرِضِينَا حَتَّى يَأْتِيَنَا تَمْر فَنَقْضِيَكِ»، فَقَالَتْ: نَعَمْ، بِأَبِي أَنْتَ يَا رَسُولَ اللَّهِ. قَالَ: فَأَقْرَضَتْهُ، فَقَضَى الْأَعْرَابِيَّ وَأَطْعَمَهُ، فَقَالَ: أَوْفَيْتَ، أَوْفَى اللَّهُ لَكَ. فَقَالَ: «أُولَئِكَ خِيَارُ النَّاسِ، إِنَّهُ لَا قُدِّسَتْ أُمَّةٌ لَا يَأْخُذُ الضَّعِيفُ فِيهَا حَقَّهُ غَيْرَ مُتَعْتَعٍ».
مَن جُعِل قاضيًا بين الناس فقد ذُبح بغير سكين
عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ جُعِلَ قَاضِيًا بَيْنَ النَّاسِ فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ».
القضاة ثلاثة: واحد في الجنة، واثنان في النار
«الْقُضَاةُ ثَلَاثَةٌ: وَاحِدٌ فِي الْجَنَّةِ، وَاثْنَانِ فِي النَّارِ*، فَأَمَّا الَّذِي فِي الْجَنَّةِ فَرَجُلٌ عَرَفَ الْحَقَّ فَقَضَى بِهِ، وَرَجُلٌ عَرَفَ الْحَقَّ فَجَارَ فِي الْحُكْمِ، فَهُوَ فِي النَّارِ، وَرَجُلٌ قَضَى لِلنَّاسِ عَلَى جَهْلٍ فَهُوَ فِي النَّارِ».
إذا جلس بين يديك الخصمان، فلا تقضين حتى تسمع من الآخر كما سمعت من الأول
عَنْ عَلِيٍّ قَالَ: بَعَثَنِي رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ إِلَى الْيَمَنِ قَاضِيًا، فَقُلْتُ: يَا رَسُولَ اللَّهِ، تُرْسِلُنِي وَأَنَا حَدِيثُ السِّنِّ، وَلَا عِلْمَ لِي بِالْقَضَاءِ؟ فَقَالَ: «إِنَّ اللَّهَ عَزَّ وَجَلَّ سَيَهْدِي قَلْبَكَ وَيُثَبِّتُ لِسَانَكَ، فَإِذَا جَلَسَ بَيْنَ يَدَيْكَ الْخَصْمَانِ فَلَا تَقْضِيَنَّ حَتَّى تَسْمَعَ مِنَ الْآخَرِ، كَمَا سَمِعْتَ مِنَ الْأَوَّلِ، فَإِنَّهُ أَحْرَى أَنْ يَتَبَيَّنَ لَكَ الْقَضَاءُ»، قَالَ: فَمَا زِلْتُ قَاضِيًا، أَوْ: مَا شَكَكْتُ فِي قَضَاءٍ بَعْدُ.
Let no one judge between two people while being angry.
‘Abdur-Rahmān ibn Abu Bakrah reported: My father wrote, or I wrote on his behalf, to his son ‘Ubaydullāh ibn Abu Bakrah, a judge in Sijistan, saying: "Do not judge between two people while being in a state of anger, for indeed I heard the Messenger of Allah (may Allah's peace and blessings be upon him) say: 'Let no one judge between two people while being angry.'" Another narration reads: "Let no judge pass judgment between two people while being angry.”
A man bought a piece of land from another man, and the one who bought the land found in his land a jar containing gold
Abu Hurayrah (may Allah be pleased with him) reported that the Prophet (may Allah’s peace and blessings be upon him) said: "A man bought a piece of land from another man, and the one who bought the land found in his land a jar containing gold. The one who bought the land said to the other: 'Take your gold. I only bought the land; I did not buy the gold.' The one who owned the land said: 'I sold you the land along with everything in it.' So they turned to a man seeking his judgment. The person they sought his judgment said to both of them: 'Do you have any children?' One of them said: 'I have a son.' The other said: 'I have a daughter.' He said: 'Marry the boy to the girl, spend it on their living expenses and give charity.’"
There were two women, each had her son with her. A wolf came and took away the son of one of them
Abu Hurayrah (may Allah be pleased with him) reported that he heard the Messenger of Allah (may Allah's peace and blessings be upon him) say: "There were two women, each had her son with her. A wolf came and took away the son of one of them. One of them said to the other: 'The wolf took your son.' The other said: 'No, it took your son.' Both of them referred the dispute to Dawūd (David) (peace be upon him), who judged that the boy belonged to the older of them. Then they went to Sulaymān (Solomon), son of Dawūd (peace be upon both of them), and told him the story. Sulaymān (peace be upon him) said: 'Give me a knife so I may cut the child into two halves and give a half to each of them.' Thereupon, the younger woman said: 'Do not do it! May Allah have mercy upon you! The child is hers.' On that, he settled the dispute in favor of the younger woman."
The testimony of a Bedouin against a city dweller is not permissible
Abu Hurayrah (may Allah be pleased with him) reported that he heard the Messenger of Allah (may Allah's peace and blessings be upon him) say: "The testimony of a Bedouin against a city dweller is not permissible.''

اسق يا زبير، ثم أرسل الماء إلى جارك
عَنْ عَبْدِ اللَّهِ بْنِ الزُّبَيْرِ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَجُلًا مِنَ الأَنْصَارِ خَاصَمَ الزُّبَيْرَ عِنْدَ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي شِرَاجِ الحَرَّةِ الَّتِي يَسْقُونَ بِهَا النَّخْلَ، فَقَالَ الأَنْصَارِيُّ: سَرِّحِ المَاءَ يَمُرُّ، فَأَبَى عَلَيْهِ، فَاخْتَصَمَا عِنْدَ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لِلزُّبَيْرِ: «اسْقِ يَا زُبَيْرُ، ثُمَّ أَرْسِلِ المَاءَ إِلَى جَارِكَ»، فَغَضِبَ الأَنْصَارِيُّ، فَقَالَ: أَنْ كَانَ ابْنَ عَمَّتِكَ؟ فَتَلَوَّنَ وَجْهُ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ قَالَ: «اسْقِ يَا زُبَيْرُ، ثُمَّ احْبِسِ المَاءَ حَتَّى يَرْجِعَ إِلَى الجَدْرِ»، فَقَالَ الزُّبَيْرُ: وَاللَّهِ إِنِّي لَأَحْسِبُ هَذِهِ الآيَةَ نَزَلَتْ فِي ذَلِكَ: {فَلاَ وَرَبِّكَ لاَ يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ} [النساء: 65]، مُتَّفقٌ عَلَيهِ، وَفِي لَفْظٍ لِلبُخَارِيِّ: فَتَلَوَّنَ وَجْهُ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ قَالَ: «اسْقِ، ثُمَّ احْبِسْ حَتَّى يَبْلُغَ الجَدْرَ»، فَاسْتَوْعَى رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حِينَئِذٍ حَقَّهُ لِلْزُّبَيْرِ، وَكَانَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَبْلَ ذَلِكَ أَشَارَ عَلَى الزُّبَيْرِ بِرَأْيٍ سَعَةٍ لَهُ وَلِلْأَنْصَارِيِّ، فَلَمَّا أَحْفَظَ الأَنْصَارِيُّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، اسْتَوْعَى لِلْزُّبَيْرِ حَقَّهُ فِي صَرِيحِ الحُكْمِ.
