A Muslim cannot inherit from a disbeliever nor can a disbeliever inherit from a Muslim
Usāmah ibn Zayd (may Allah be pleased with him) reported: The Prophet (may Allah's peace and blessings be upon him) said: "A Muslim cannot inherit from a disbeliever nor can a disbeliever inherit from a Muslim."
My heirs should not take a dinar or dirham. Whatever I leave behind, excluding the provision for my wives and my employees, should be spent in charity
Abu Hurayrah (may Allah be pleased with him) reported: The Messenger of Allah (may Allah’s peace and blessings be upon him) said: "My heirs should not take a dinar or dirham. Whatever I leave behind, excluding the provision for my wives and my employees, should be spent in charity."
People of two different religions do not inherit from one another
‘Abdullāh ibn ‘Amr ibn al-‘Ās (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: "People of two different religions do not inherit from one another."
لا تسألوني ما دام هذا الحبر فيكم
عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ قَالَ: سُئِلَ أَبُو مُوسَى عَنْ ابنةٍ وَابْنَةِ ابْنٍ وَأُخْتٍ، فَقَالَ: لِلابْنَةِ النِّصْفُ، وَلِلْأُخْتِ النِّصْفُ، وَأْتِ ابْنَ مَسْعُودٍ فَسَيُتَابِعُنِي، فَسُئِلَ ابْنُ مَسْعُودٍ، وَأُخْبِرَ بِقَوْلِ أَبِي مُوسَى، فَقَالَ: لَقَدْ ضَلَلْتُ إِذن وَمَا أَنَا مِنَ المُهْتَدِينَ، أَقْضِي فِيهَا بِمَا قَضَى النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: لِلاِبْنَةِ النِّصْفُ، وَلِابْنَةِ ابْنٍ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ، وَمَا بَقِيَ فَلِلْأُخْتِ، فَأَتَيْنَا أَبَا مُوسَى فَأَخْبَرْنَاهُ بِقَوْلِ ابْنِ مَسْعُودٍ، فَقَالَ: لاَ تَسْأَلُونِي مَا دَامَ هَذَا الحَبْرُ فِيكُمْ.
Give the prescribed shares (of inheritance) to those who are entitled to them, and whatever remains goes to the nearest male relative
Ibn ‘Abbās (may Allah be pleased with him and his father) reported that the Prophet (ﷺ) said: "Give the prescribed shares (of inheritance) to those who are entitled to them, and whatever remains goes to the nearest male relative."
قلت يا رسول الله، أتنزل غدا في دارك بمكة؟ قال: وهل ترك لنا عقيل من رباع؟
عن أسامة بن زيد- رضي الله عنه- مرفوعاً: «قلت ُيا رسول الله، أتنزل غدا في دارك بمكة؟ قال: وهل ترك لنا عقيل من رِبَاعٍ؟ ثم قال: لا يَرِثُ الكافر المسلم، ولا المسلم الكافر
If anyone leaves behind a debt or a helpless family, I shall be responsible. But if anyone leaves wealth, it goes to his heirs. I am the heir of him who has none, paying blood money on his behalf and inheriting from him. And a maternal uncle is the heir of him who has none, paying blood money on his behalf and inheriting from him
Al-Miqdām (may Allah be pleased with him) reported that the Messenger of Allah (may Allah's peace and blessings be upon him) said: ''If anyone leaves behind a debt or a helpless family, I shall be responsible. But if anyone leaves wealth, it goes to his heirs. I am the heir of him who has none, paying blood money on his behalf and inheriting from him. And a maternal uncle is the heir of him who has none, paying blood money on his behalf and inheriting from him.''
A newborn who cries after birth is entitled to inheritance
Jābir (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: "A newborn who cries after birth is entitled to inheritance."
يا عمر، ألا تكفيك آية الصيف التي في آخر سورة النساء
عن مَعْدَان بن أبي طلحة أن عمر بن الخطاب خطب يوم جمعة، فذكر نبي الله صلى الله عليه وسلم، وذكر أبا بكر، ثم قال: إني لا أدع بعدي شيئًا أهم عندي من الكلالة، ما راجعتُ رسول الله صلى الله عليه وسلم في شيء ما راجعتُه في الكَلَالة، وما أغلظ لي في شيء ما أغلظ لي فيه، حتى طعن بإصبعه في صدري، وقال: «يا عمر، ألا تكفيك آية الصيف التي في آخر سورة النساء»، وإني إن أعش أقض فيها بقضية يقضي بها من يقرأ القرآن، ومن لا يقرأ القرآن.
